Okay, well, I asked Marty Schwimmer and he says maybe he’ll oppose on the ground that it’s descriptive of my legal services. I don’t think that’s fair. I think he’s thinking of my legal career.

I can’t blame him for being confused, though. But of course he’d say that, given the utterly descriptive name of certain other trademark blogs. Slightly better known ones. (Better known and better written, probably. But the odds of acquiring distinctiveness?)

UPDATE:  Ich couldn’t have said it better.

    Actually, John’s not confused, he’s merely asking about affiliation. Clearly, he knows the difference between the two, and thus not actually confused. I on the other hand am confused.
