Carson Griffith’s defamation lawsuit gets out of the gate

Last July I filed this amended complaint on behalf of journalist Carson Griffith. She had filed a pro se complaint against The Daily Beast earlier in the year in New York Supreme Court in Manhattan.

Mine was better.

A motion to dismiss, followed, as they always do in defamation cases, of course. Here’s a link to our brief in opposition to the motion. And below is the short and sweet opinion and order denying the Daily Beast motion, and to the story on Fox News reporting the outcome. (They get a little confused and quote the original complaint, not the amended complaint.)

This outcome is gratifying, of course, but it’s not the apex of achievement. The bar to dismiss a complaint on the pleadings is the same under New York law as it is under federal law.

Either way, Carson Griffith’s lawsuit proceeds against Daily Beast.
