This is somewhat off topic, but if, like me, you’d be happy to live off the interest on Mike Ovitz’s obscene payout from his brief and disastrous vacation at Disney, you’ll be interested in knowing that the fat lady has not sung in that case.
This is about the business judgment rule, and the current appeal before the Delaware Supreme Court is whether the lower court erred in ruling that as far out as the Ovitz deal was, it wasn’t more than just the bad business decisions guys like Michael Eisner are (or in his case, were) paid to make.
UPDATE: It’s over. Was it ever really a question?
