This Thursday is the hot summer half-day of sizzling CLE: The “Hot Topics in Intellectual Property” extravaganza at the New York Intellectual Property Association. And I will be presenting on the problem of how to square “incontestable” trademark registration privileges with a defense of genericness to a claim of infringement.
If it’s “incontestable,” how can you defend against the validity of the trademark? Well, if it’s generic, how is it a trademark? Pieces of paper with gold seals on them don’t make trademarks.
If this sounds familiar, yes, I have written about this hot topic before, in this post. And I have litigated it, too (that litigation is still in progress). So I will not use up what few ideas I may have left on the matter, or I’ll have to change my mind about by Thursday.
